Confidentiality

Professional Secrecy
According to the NIP professional code (Article 71), the law (Article 88 of the BIG Act and Article 457 of the WGBO), and the Youth Act (Article 7.3.11), psychologists are bound by professional secrecy, meaning they are obligated to keep confidential anything they learn in the course of their profession. Clients can trust that they can speak freely with a psychologist without their information becoming public.

PERSONAL DATA

PROCESSING OF PERSONAL DATA

Personal data of clients are processed by Psylicht for the following purposes:

  • Administrative purposes
    To identify you.
  • Communication
    To communicate about the treatment with you or important others (only with your consent).
  • Carefulness
    To provide psychological treatment carefully and verifiably (various background information is important for making the correct treatment indication, tracking progress, evaluating, and adjusting treatment if necessary).
  • Legal Obligation
    To comply with the legal requirement to provide certain information to the DIS (DBC Information System) regarding treatments covered by the Healthcare Insurance Act.

Treatment Agreement

The basis for collecting and processing these personal data is the treatment agreement, which you sign for approval at the start of the treatment.

COMPLAINTS

At Psylicht, we highly value the protection of your personal data. We do our utmost to ensure that your data is handled securely and confidentially. If you have a complaint about the processing of your personal data, you can contact Ms. Drs. E.M. van der Pal directly.

She will take your complaint seriously and do everything possible to find a reasonable solution together. Additionally, you always have the right to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), the supervisory authority for privacy protection.

We are always ready to handle any concerns or complaints about the processing of your personal data in a professional and careful manner.

RIGHT OF ACCESS, CORRECTION, OR DELETION OF YOUR DATA

You have the right to request access to, correction of, or deletion of your data. Please refer to our contact page for this.

To prevent misuse, we may ask you to adequately identify yourself. If you request access to personal data linked to a cookie, you must send a copy of the specific cookie. No Use of Cookies

Privacy Statement

Psylicht highly values careful handling of your data. Therefore, this privacy statement.

Your File

The law requires psychologists to maintain a client file. This file contains necessary information to:

  • Provide proper care and conduct thorough examinations.
  • According to the WGBO/Youth Act, treatment providers are legally required to keep files for 15 years.
  • Outside a treatment context, Psylicht keeps your file for 20 years.

Your Rights

As a client, you have the right to inspect or receive a copy of the information in your file. If you find factual inaccuracies, you can request us to correct or supplement the information. If you disagree with the information in your file, you can ask us to add your own statement (your opinion) to the file.

You also have the right to request the deletion of (parts of) your file. We generally honor these requests unless we believe that the interests of others, such as your partner or children, would be harmed.

Confidentiality

As psychologists, we have a duty of confidentiality. This means we only discuss you or your child with others if you explicitly consent. Only in exceptional cases does the law allow us to share information without your consent. In such cases, we will first contact you to discuss the disclosure.

Rights of You and Your Children

  • Children under 12 years old → Parents with parental authority exercise the child’s rights.
  • Children aged 12-16 years → Both the child and parents with parental authority exercise the child’s rights.
  • Children aged 16 and older → The child exercises their rights independently.

If a child or adult is unable to exercise their rights due to a disability or mental condition, the legal guardian, mentor, or curator acts on their behalf. If none is appointed, the partner, parent(s), siblings, or an adult child may exercise these rights.

Legal Basis for Processing

The Dutch Data Protection Authority (AP) must base the use of personal data on one of the legal grounds from Article 6 of the GDPR. This includes fulfilling a task of public interest or exercising official authority.

Security of Personal Data

Under Article 32 of the GDPR, we take appropriate technical and organizational measures to prevent data loss or unlawful processing.

We anonymize IP addresses in log files before storage and retain logs for 31 days before deleting them, keeping only aggregated data for website analysis.

We never share personal data with third parties, except when required for criminal investigations.
